Then all this is multiplied by the number of days of the calendar in incomplete months.
How to calculate the vacation that is provided on working days
Leave on working days is given to employees,who entered into a labor contract for a period of up to 2 months. They receive paid holidays or compensations during layoffs at the rate of 2: 1 (2 working days per month of work).
Leave in case of work, on a part-time basis
The employer establishes a leave depending on thefrom the work performed with pay, which is proportional to the time worked. It is also worth noting that work with an incomplete work schedule does not limit employees in the duration of the main paid vacation every year. Employees are given leave with a duration of 28 calendar days, and the workplace is not changed, as is the earnings. Unused leave: compensation
All workers, without exception, haveopportunity, for each unused vacation, receive monetary compensation. Thus, even the employee who was fired, is obliged to receive monetary compensation for each unused vacation. It is necessary to pay attention to the case when the employee is dismissed as a transfer, he too can receive compensation. It is necessary to know how to correctly calculate the leave, because when you leave, you must take into account important nuances. Thus, if the employee has worked less than half a month, then this time must be excluded from the accounting of compensation payments for unused leave. In case if half or more half of the month is worked out, then this period is rounded to the full month.
Calculation of compensation for leave on leave
For example, the duration of leave forthe employee being dismissed is 28 days, then he must be compensated for 23.33 days (28: 12 x 10). Such a result should not be rounded up to an entire number of calendar days.
But how to calculate the period of leave if the employeeworked not 10, but 11 months? In this situation, he needs to pay compensation for the worked out 28 days of leave. Since by law the dismissed workers who have worked at the employer for at least 11 months have the right to receive full compensation (since they are subject to credit in the term of work).
The Labor Code prohibits not letting goemployees on leave for more than two years in a row, even if the employee himself refuses (although this sounds a bit strange). However, such cases are not uncommon. Nevertheless, this is a direct violation of labor law. Therefore, all organizations that will be seen in this violation will be punished according to the law, fines and deductions will be imposed.
