The Labor Code provides that whenThe employee is compensated for unused labor leave. In this regard, not only personnel officers, but also the employees themselves need to know how to calculate leave upon dismissal.

If at the time of dismissal, the employee hasunused vacation, then he has the right to take it off before his dismissal. To do this, the employee submits an application in which he asks the administration to grant him leave with subsequent dismissal. In this case, the dismissal of the employee occurs on the last day of his leave. On this day he must be given all the documents and the final calculation is made.

However, upon dismissal, the employee has the right not touse the days off, and get paid for them. If the employee spends his vacation "upfront", then when dismissed from him must be kept unnecessarily received the amount of vacation.

In any case, it is important to know how to calculate the leave when you leave. And for this it is necessary to determine how many days of vacation the worker is entitled to for each month of work.

Let's take a closer look at howthe leave is calculated upon dismissal on a simple example: the total duration of leave for the employee is 28 working days; vacation period from 15.03.2011 to 14.03.2012. Date of dismissal 23. 07. 2012.

In order to determine how many days of vacation are not used by the employee, you should perform the following actions:

  1. In order to find out how many days are put to the employee for each month of work, you need to divide the total vacation by 12 (the number of months in a year): 28: 12 = 2,33 days.
  2. On the day of dismissal, the employee has worked for 4 months and9 days. Considering that 9 days is less than half a calendar month, they are not taken into account for calculating leave and compensation is calculated for 4 months. If an employee worked 15 or more days, they would be rounded up to a whole month.
  3. If for each month the employee is entitled to 2.33 daysleave, then for 4 months: 2.33 * 4 = 9.33 days. The number of days of leave upon dismissal is often expressed in fractional numbers. With cash compensation, vacation days are not rounded. If the employee wants to go on leave with subsequent dismissal, the vacation days are rounded up. In our case, the employee before the dismissal is entitled to use 10 working days of leave.
