What is an offer and an acceptance?
If you ever had to read the termsthe provision of services of a site, then you probably met such terms as an offer and an acceptance. So let's figure out what an offer and an acceptance are, and also what connection exists between them.
When it comes to contracts, we, as a rule,we recall the texts with a list of different conditions, which are compiled in an arbitrary form in two copies. After that, both parties sign on these contracts and print on them (if the parties to the agreement are legal entities). Then each side takes one copy to itself.
However, there are other types of contracts, for example, oral agreements. To conclude such a contract, you do not need to draw up any documents. But such contracts can not be applied in all areas. So what to do if you need to write a written contract, but there is no way to make a physical exchange of documents? In such cases, the offer will help. An offer is a document placed anywhere: on the site, on a box of a product, etc. Such a document automatically starts to be considered an offer, except for the case if it expressly states that it is not. If such a document is drawn up so that it is possible to determine its sender, then in the event of an acceptance this contract can be considered written prisoner. What is an acceptance? This is the acceptance of the conditions specified in the contract, and the commission of actions, which are indicated in the text of the offer.
